| 1 Year Water Sensor Warranties |
| The limitations of liability set forth below include body and all component parts as well as the product itself as a whole. VENUE: Any purchaser or third party actions brought for any reason hereunder shall be commenced in Manatee County and no other jurisdiction, and such action shall be governed by and construed in accordance with the laws of the State of Florida. Any notice herein shall be sent to Resource Conservation Technologies, Inc., by certified or registered mail at 6408 Parkland Drive, Suite 102 Sarasota, FL 34243. Resource Conservation Technologies (“RCT”) warrants to the original consumer purchaser (“Purchaser”) of its AquaGuard Products, that they are free from defects in material or workmanship. If within the listed coverage period (see below) this product shall prove to be defective, it shall be repaired or replaced at RCT’s option, subject to the terms and conditions set forth below. Your original receipt of purchase is required to determine warranty eligibility. |
| 3, 5 and 10 Year Secondary Drain Pan Warranties |
| Resource Conservation Technologies (“RCT”) warrants the secondary drain pan to be free from defects in factory workmanship and material under normal use and service and will, at its option furnish a replacement secondary drain pan that meets the intended fit, use and function of the original secondary drain pan for any secondary drain pan furnished by RCT, which proves to have such defects within three, five or ten (3, 5 or 10) years from the date determined in accordance with the next paragraph. RCT shall have no responsibility hereunder for installation, shipping, handling or other charges except as specifically provided herein. For your benefit and protection, return the warranty registration card with pan serial number to RCT within thirty (30) days of installation. The 10–digit serial number is located on the drain pan label. This will initiate the warranty period and will allow us to contact you, should it become necessary. In the absence of a recorded warranty card, the warranty period will begin upon product shipment from RCT. In the event that RCT attempts to contact consumers regarding a recall or other matter and any damages occur, which could have been avoided by registration by the consumer, RCT shall have no liability. This warranty extends only to the original consumer purchaser and is non-transferable. For this warranty to apply, the product must be installed according to RCT recommendations and specifications, and in accordance with all local, state and national codes, and the product must not be removed from its place of original installation. The warranty period for replacement provided hereunder shall not extend beyond the warranty period stated above. Consumer agrees to inspect the secondary drain pan at the time of installation for any reasonable defects and, further agrees to inspect the secondary drain pan annually. Any damages occurring which could have been avoided by proper inspection will not be the responsibility of RCT. |
| This warranty covers the secondary drain pan only, and is subject to the following conditions: 1. The product has been installed according to manufacturer’s instructions. 2. The product has not been moved from its original place of installation. This warranty applies only to secondary drain pans installed in the United States and Canada. |
| EXCLUSIONS |
| This warranty does not cover: 1. Damages resulting from installation or servicing. 2. Damages resulting from accident, abuse, fire, flood, alteration, or acts of God. (Tampering, altering, defacing or removing the product label will serve to void the warranty). 3. Damages resulting from the use of corrosive material (including, but not limited to: Acetone, MEK). 4. Damages resulting from use of components or accessories not approved by RCT. |
| THIS WARRANTY IS IN LIEU OF ALL OTHER WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. SOME STATES DO NOT ALLOW THE EXCLUSION OF LIMITATION OF INCIDENTAL AND CONSEQUENTIAL DAMAGES OR LIMITATIONS ON HOW LONG IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. IN ALL CIRCUMSTANCES, RCT’S MAXIMUM LIABILITY SHALL NOT EXCEED THE ACTUAL PURCHASE PRICE PAID FOR THE PRODUCT ALONE. WARRANTY CLAIMS MUST BE REGISTERED WITH RCT WITHIN THIRTY (30) DAYS OF DAMAGE OR MALFUCTION. RCT RESERVES THE RIGHT TO VISIT THE SITE OF THE INSTALLATION OR TO REQUIRE DOCUMENTATION OF THE CLAIM BEFORE ASSUMING ANY RESPONSIBILITY UNDER THE PROVISIONS OF THE WARRANTY. ANY COSTS ASSOCIATED WITH THE REPAIR OR REPLACEMENT OF THE SECONDARY DRAIN PAN IS THE RESPONSIBILITY OF THE OWNER. ANY INSTALLATION NOT CONFORMING TO RCT’S SPECIFICATIONS, MANUALS OR INSTRUCTIONS OR ANY MISUSE OR ANY MODIFICATION NOT AUTHORIZED BY RCT VOIDS THIS WARRANTY. THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS AND YOU MAY ALSO HAVE OTHER LEGAL RIGHTS THAT VARY FROM STATE TO STATE. VENUE FOR ANY LITIGATION REGARDING OR RELATING TO THE SUBJECT SECONDARY DRAIN PAN SHALL BE BROUGHT ONLY IN A STATE COURT OF COMPETENT JURISDICTION IN MANATEE COUNTY, FLORIDA. |
